1. Acceptance of Terms

By accessing or using the services provided by Americas Best Coins LLC ("Company," "we," "us," or "our") through our website at americasbestcapital.com or any related platforms, you ("User," "you," or "your") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not access or use our services.

These Terms constitute a legally binding agreement between you and Americas Best Coins LLC. We reserve the right to modify these Terms at any time. Continued use of our services after any modifications constitutes acceptance of the updated Terms.

2. Eligibility

To use our services, you must:

  • Be at least 18 years of age;
  • Be a resident of the United States or a U.S. person as defined by applicable law;
  • Have the legal capacity to enter into a binding agreement;
  • Not be located in, or a citizen or resident of, any jurisdiction where the purchase of cryptocurrency is prohibited or restricted;
  • Not be listed on any U.S. government sanctioned party list, including but not limited to the OFAC Specially Designated Nationals (SDN) list;
  • Provide accurate and complete information during the registration and verification process.

3. Account Registration & KYC Requirements

As a federally registered Money Services Business (FinCEN Registration #31000271222452), we are required by law to verify the identity of all customers before processing transactions. This process, known as Know Your Customer (KYC), requires you to provide:

  • Your full legal name;
  • Date of birth;
  • Residential address;
  • A valid government-issued photo identification (driver's license, passport, or state ID);
  • Social Security Number (SSN) or Individual Taxpayer Identification Number (ITIN) for transactions above certain thresholds;
  • Any additional documentation we may reasonably request for verification purposes.

You agree to provide accurate, current, and complete information. Providing false or misleading information is a violation of these Terms and may result in account suspension and reporting to appropriate authorities.

4. Supported Assets

Americas Best Coins LLC currently supports the purchase of the following cryptocurrencies:

  • Bitcoin (BTC)
  • Ethereum (ETH)
  • Litecoin (LTC)
  • Tether (USDT)
  • USD Coin (USDC)

We may add or remove supported assets at our sole discretion. We will make reasonable efforts to notify users of any changes to our supported asset list.

5. Purchase Process & Settlement

When you initiate a cryptocurrency purchase through our platform:

  • You will be shown the current price, applicable fees, and total amount due before confirming the transaction;
  • Once you confirm a transaction, it is considered final and binding;
  • The quoted price is valid only at the time of confirmation — cryptocurrency prices are highly volatile and may change rapidly;
  • Settlement times vary by payment method (see FAQ for details);
  • Cryptocurrency will be delivered to the wallet address you provide — you are solely responsible for ensuring the accuracy of this address;
  • We are not responsible for cryptocurrency sent to an incorrect wallet address.

6. Payment Methods & Fees

We accept the following payment methods: Visa, Mastercard, American Express, Discover, ACH transfers, bank wires, Apple Pay, Google Pay, Zelle, and Cash App.

All fees are disclosed prior to transaction confirmation. Fee amounts may vary based on payment method, transaction amount, and the cryptocurrency selected. You are responsible for any fees charged by your bank or payment provider in connection with your payment to us.

7. No Refund Policy

All cryptocurrency purchases are final and non-refundable. Due to the nature of blockchain technology, once a transaction has been broadcast to the network and confirmed, it cannot be reversed, cancelled, or refunded. By confirming a purchase, you acknowledge and accept this irreversibility.

If you believe a transaction was made in error, contact our support team immediately. While we cannot reverse completed blockchain transactions, we will investigate the matter and assist where possible.

8. Prohibited Activities

You agree not to use our services for any of the following:

  • Money laundering, terrorist financing, or any other illegal activity;
  • Purchasing cryptocurrency on behalf of another person without proper authorization;
  • Using stolen payment methods or engaging in fraudulent transactions;
  • Circumventing or attempting to circumvent our KYC/AML procedures;
  • Using automated systems, bots, or scripts to interact with our services;
  • Any activity that violates applicable local, state, federal, or international law.

9. AML/BSA Compliance

Americas Best Coins LLC maintains a comprehensive Anti-Money Laundering (AML) program as required by the Bank Secrecy Act (BSA) and FinCEN regulations. Our program includes:

  • Customer identification and verification (KYC);
  • Transaction monitoring for suspicious activity;
  • Filing of Currency Transaction Reports (CTRs) for transactions exceeding $10,000;
  • Filing of Suspicious Activity Reports (SARs) when warranted;
  • Ongoing employee training;
  • Independent testing of AML controls;
  • OFAC screening of all customers against sanctioned party lists.

We reserve the right to suspend, delay, or refuse any transaction that we believe may violate our AML policies or applicable law.

10. Risk Disclosure

Cryptocurrency purchases involve significant risk. By using our services, you acknowledge and accept the following:

  • Cryptocurrency prices are highly volatile and can experience significant price swings in short periods;
  • You may lose some or all of the value of your cryptocurrency holdings;
  • Cryptocurrency is not legal tender and is not backed by any government;
  • Cryptocurrency is not insured by the Federal Deposit Insurance Corporation (FDIC) or the Securities Investor Protection Corporation (SIPC);
  • Regulatory changes may affect the value, legality, or accessibility of certain cryptocurrencies;
  • Past performance is not indicative of future results;
  • Americas Best Coins LLC does not provide investment, financial, tax, or legal advice.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Americas Best Coins LLC, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or cryptocurrency value, arising out of or related to your use of our services.

Our total aggregate liability for any claims arising out of or related to these Terms or our services shall not exceed the amount of fees paid by you to us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Americas Best Coins LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of our services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any inaccurate or incomplete information you provide to us.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through our website or via email to registered users. Your continued use of our services following the posting of updated Terms constitutes your acceptance of such changes. If you do not agree to the updated Terms, you must discontinue use of our services.
